Terms
The terms that govern using and subscribing to the Derksyon platform.
Platform Terms of Use
1. Scope
These terms govern the use of the admin, websites and pages the Platform provides to schools, their staff and captains. Using the Platform means accepting these terms, the Subscription Agreement and the Data Processing Addendum.
2. Accounts and security
2.1 The account owner keeps the password, and the captains' PINs, confidential and does not share them.
2.2 The school owner is responsible for the accounts they add (staff and captains) and for removing them when they leave.
2.3 Suspected unauthorised use must be reported to the Platform at once.
3. Acceptable use
The Platform must not be used to:
3.1 publish unlawful or misleading content or content infringing others' rights (including photos and trademarks);
3.2 message people who did not agree to receive messages, or break WhatsApp's policies;
3.3 try to reach another school's data, disrupt the service, or test its security without written permission;
3.4 collect learners' data for any purpose other than teaching and booking.
4. Content
4.1 The school is responsible for the accuracy of what it publishes: prices, hours, licence details, promises and policies.
4.2 The sample data a school starts with is only an example; the school reviews and edits it before opening the site to the public.
4.3 The Platform keeps its rights in the software, design and templates; the school receives a right of use for the duration of its subscription.
5. Third-party services
The Platform relies on providers (including Vercel for hosting, Supabase for the database and storage, Meta for WhatsApp, Resend for e-mail once enabled, and Paymob for card payments once enabled). Their terms also apply.
6. Availability and changes
6.1 The service may pause for maintenance or for reasons beyond the Platform's control; planned maintenance is announced in advance where possible.
6.2 The Platform may develop or change features; a core feature of a paid plan is not removed during a running cycle.
7. Suspension and termination
The Platform may suspend an account that breaks these terms, telling the school owner why; the Subscription Agreement's provisions on data after termination apply.
8. Contact
Contact and support: “Need help?” in the admin.
9. Changes
Changes are published as a new version, to be accepted at the first sign-in after publication.
Subscription Agreement
1. Parties
1.1 Provider: the operator of the Derksyon platform (the "Platform").
1.2 Subscriber: the driving school registered on the Platform under its own name, represented by the account owner who accepts this agreement (the "School").
2. The service
2.1 The Platform provides the School with a booking website, an admin to manage bookings, captains and payments, a private page for each learner, a page for each captain, attendance tickets, reports, Excel import and WhatsApp messages, according to the chosen plan (section 3).
2.2 The service is provided "as is" and "as available". The Platform takes reasonable care to keep it available and secure but does not guarantee uninterrupted service.
2.3 Some features rely on third parties (e.g. Meta/WhatsApp, payment providers, hosting). The Platform is not liable for their outages or changes of terms or prices; the School follows those parties' terms for its own accounts with them (e.g. the School's WhatsApp number).
3. Plans and fees
3.1 The School chooses one of two plans, "Essential" («الأساسية») or "Complete" («الكاملة»), paid monthly (or yearly if so agreed), at the prices published when it subscribes. Both plans include the service described in 2.1, including WhatsApp messages sent automatically from the School's number with the conversations inbox; they differ only in two things: the number of captains (up to 5 on "Essential", unlimited on "Complete") and connecting the School's own domain ("Complete" only).
3.1.1 If the School has more captains than its plan allows (for example after moving to "Essential"), all existing captains keep working; no new captain can be added until the School moves to a higher plan or the number falls below the limit.
3.2 A one-time setup fee may apply, depending on the plan.
3.3 Trial: 14 days from the School's creation on the "Complete" plan unless agreed otherwise; the Platform may extend it.
3.4 Founder price: a locked price granted to the School stays in force as long as the subscription continues without a gap of more than 30 days, even if published prices change.
3.5 The Platform announces any price change at least 30 days in advance; it applies from the next cycle.
3.6 How VAT applies to the prices will be set in a later version of this agreement.
4. Payment
4.1 The School pays in advance for each cycle by one of the methods shown on its «الاشتراك» page (InstaPay, mobile wallet, bank transfer, cash).
4.2 The School sends its transfer receipt from that page; the Platform confirms it or rejects it with a reason. Every confirmed payment gets a numbered receipt.
4.3 A paid cycle runs from the day after the previous one ends when paid on time or within the grace days, and from the day of payment when the subscription was suspended.
5. Late payment and suspension
5.1 The Platform sends reminders before renewal (by default 7, 3 and 1 days before).
5.2 After the due date the School has 7 grace days with everything working.
5.3 When the grace days end unpaid, the admin is locked except the subscription page; the public website and existing bookings keep working for 14 days, after which visitors see that the site is "temporarily unavailable".
5.4 Suspension never deletes the School's data; everything comes back as soon as payment is confirmed.
5.5 The Platform may suspend the School at once for a material breach of this agreement or the platform terms, stating the reason.
6. Data ownership
6.1 The School's data and content (texts, photos, prices, bookings and learners' details) remain the School's.
6.2 The School grants the Platform a limited licence to host and process them only to provide the service, under the Data Processing Addendum.
6.3 The School may request a copy of its data at any time, and within 30 days after the subscription ends.
7. Term and termination
7.1 This agreement starts on acceptance and renews with each paid cycle.
7.2 The School may end its subscription at any time; amounts paid for the current period (a month or a year, depending on the billing cycle) are not refunded unless agreed.
7.3 After termination the Platform keeps the data for 30 days so the School can export it, then deletes or anonymises it, except what the law requires keeping (e.g. invoicing records).
8. Limitation of liability
8.1 The Platform's total liability for any claim is limited to the amounts the School paid in the three months before the event.
8.2 The Platform is not liable for indirect damages, lost profits or lost bookings.
8.3 The School alone is responsible for its licences, its dealings with learners, and the accuracy of what it publishes.
9. Support
9.1 Support is given through “Need help?” in the admin, on working days from 10:00 to 18:00 Cairo time.
10. Governing law and disputes
10.1 This agreement is governed by the laws of the Arab Republic of Egypt.
10.2 The parties try to settle any dispute amicably within 30 days; otherwise the courts of Cairo have jurisdiction.
11. General
11.1 This agreement, the Platform Terms and the Data Processing Addendum are the entire agreement between the parties.
11.2 Electronic acceptance in the admin (recorded with its date and version) counts as written acceptance.
11.3 The Platform announces any material change at least 30 days in advance and asks for acceptance of the new version at the first sign-in after it.
